Explanation:
The University of Aberdeen considers the use of the negotiated procedure without prior publication of a contract notice in terms of Regulations 33(1)(b)(iii) of the Public Contracts (Scotland) Regulations 2015 is justified because of absences of competition for technical reasons - i.e. Waters, the proprietary holders, are the only provider for support of the Empower and Nugenesis software packages. No independent company could be found on the internet within the UK that could provide support for these software platforms.
